blackEX collects information necessary to operate, secure, and improve the Platform. The types of information collected may include, but are not limited to:

• Account Identifiers: Such as a user’s name, email address, username, and other registration details provided during account creation or account management.
• Authentication and Access Logs: Records related to login activity, authentication attempts, access times, and session information used to protect accounts and enforce security controls.
• Usage and Transaction Data: Information about how users interact with the Platform, including content accessed, features used, transactions performed, and service-related activity.
• Technical Data: Information such as IP addresses, browser type, operating system, device identifiers, and other technical attributes collected automatically to support platform functionality, security monitoring, and troubleshooting.
• Security and Audit Logs: System-generated logs used for monitoring, auditing, incident detection, investigation, and compliance with contractual, regulatory, and security obligations.

blackEX collects only the minimum amount of data reasonably necessary for these purposes and does not intentionally collect sensitive personal information unless required for lawful and disclosed business purposes.
 

2.2 Purpose of Collection

blackEX collects and processes personal and technical information for the following legitimate business purposes:

• Service Delivery and Security: To provide, operate, maintain, and secure the Platform, including authentication, authorization, access control, and system integrity.
• Fraud Prevention and Abuse Detection: To detect, prevent, investigate, and respond to fraud, unauthorized access, misuse of content, or violations of Platform policies.
• Legal and Contractual Compliance: To meet obligations under U.S. federal and state laws, licensing agreements, content protection requirements, and contractual commitments with clients and rights holders.

blackEX does not sell personal data. Information may be shared only under limited and controlled circumstances, including:

• Trusted Service Providers: Third-party vendors and service providers that support Platform operations, including hosting, security monitoring, and payment processing, and who are bound by contractual obligations to protect data and use it solely for authorized purposes.
• Rights Holders: Content owners or licensors when contractually required to enforce content usage restrictions, investigate misuse, or meet licensing and audit requirements.
• Legal and Regulatory Authorities: U.S. law enforcement, courts, or regulatory bodies when disclosure is required by law, subpoena, court order, or other valid legal process.

blackEX takes reasonable steps to ensure that any data sharing is consistent with this Policy and applicable legal requirements.

2.4 User Rights (U.S.)

Subject to applicable U.S. laws and contractual obligations, users may request:

• Access: Confirmation of whether blackEX processes their personal data and access to such data where legally permissible.
• Correction: Correction of inaccurate or incomplete personal information maintained by blackEX.
• Deletion: Deletion of personal data where permitted by law and not subject to retention requirements for security, legal, or contractual purposes.

Requests may be limited, delayed, or denied where necessary to comply with legal obligations, protect the security of the Platform, prevent fraud, or preserve the rights of blackEX or third parties.

blackEX employs industry-standard administrative, technical, and physical safeguards designed to protect personal data against unauthorized access, disclosure, alteration, or destruction.
